Please read these terms carefully before using BeatID.
1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and BeatID ("we", "our", "us") governing your access to and use of the BeatID mobile application, website, and all related services (collectively, the "Service").
By downloading, installing, or using BeatID, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use BeatID.
2. Licence & Access
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to:
- Download and install one copy of the BeatID app on an iOS device you own or control.
- Access and use the Service for your personal, non-commercial purposes.
This licence does not include the right to:
- Resell, sublicense, or distribute the Service or any content within it.
- Modify, reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service to build a competing product or service.
- Remove or alter any proprietary notices or labels.
3. User Accounts
When you create an account with us, you agree to:
- Provide accurate, complete, and current information.
- Maintain the security of your credentials and not share your account.
- Notify us immediately of any unauthorised use of your account.
- Accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behaviour.
4. Acceptable Use
You agree not to use the Service to:
- Cheat, exploit bugs, or use unauthorised third-party software to gain an unfair advantage.
- Harass, threaten, or harm other users.
- Submit false, misleading, or offensive content.
- Attempt to gain unauthorised access to our systems, other users' accounts, or any related networks.
- Interfere with or disrupt the integrity or performance of the Service.
- Engage in any activity that violates applicable laws or regulations.
- Collect or harvest data about other users without their consent.
5. Intellectual Property
The Service and its original content (excluding content licensed from third parties) are and will remain the exclusive property of BeatID. Our trademarks, trade dress, logos, and service marks may not be used in connection with any product or service without our prior written consent.
If you provide feedback, suggestions, or ideas about the Service, you grant us an irrevocable, royalty-free, worldwide licence to use that feedback without restriction or compensation to you.
6. Music Content & MusicKit
BeatID uses Apple MusicKit to play licensed music content. All music streamed through the Service is subject to Apple's licensing agreements with rights holders. You acknowledge that:
- Song snippets are streamed, not downloaded or stored on your device by our app.
- Your use of music content is solely for personal, non-commercial entertainment within the app.
- You may not record, reproduce, or redistribute any audio content accessed through BeatID.
- Access to certain music features requires a valid Apple Music subscription.
BeatID does not claim ownership of any music content and all rights remain with the respective copyright holders and Apple's licensors.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure.
- Any defects will be corrected.
- The Service or servers are free of viruses or other harmful components.
- The results obtained from using the Service will be accurate or reliable.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEATID AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $10.
9. Indemnification
You agree to defend, indemnify, and hold harmless BeatID and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgements, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Service.
10. Termination
We may terminate or suspend your access to the Service immediately, without notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
You may terminate your account at any time by deleting the app and contacting us at hello@example.com to request account deletion.
All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [YOUR STATE / COUNTRY], without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in [YOUR JURISDICTION].
12. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you via in-app notification or email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
